The President of the Federal Senate has promulgated the Legislative Decree No. 49/2019, regarding the Brazil’s accession to the Madrid Protocol

On May 30, 2019, the President of the Federal Senate has promulgated the Legislative Decree No. 49/2019, regarding the Brazil’s accession to the Madrid Protocol. In such promulgation, the texts relating to the Madrid Agreement and the respective Protocol to that Agreement – which concerns to the international registration of trademarks – were approved, as well as 8 (eight) declarations and notifications were formulated, among which we highlight:

a) The maximum term for the Brazilian PTO will be 18 (eighteen) months, and it may be extended (in specific circumstances) when there is opposition;

b) Brazil has opted to receive an individual fee for international registrations and renewals (which may be greater than that defined by the World Intellectual Property Organization – WIPO);

c) The official languages shall be English and Spanish.
